The following Terms & Conditions are based on the Austrian Hotel Contract Conditions (AGBH 2006) and apply to all stays at Albizia Apartments unless we reach an individual agreement with you. They summarise your rights and obligations in English; the German version remains legally binding.

§ 1 Scope

These terms supplement any special arrangements agreed with you. Individual agreements take precedence, while the AGBH apply subsidiarily.

§ 2 Definitions

“Accommodation provider” refers to Rebbe Horst DI & Rebbe Larissa Dr. GesbR, trading as Albizia Apartments. “Guest” is any person using accommodation. The “contract partner” is the person who concludes the agreement with us; this may correspond to the guest or a third party. “Consumer” and “entrepreneur” follow the meanings under Austrian consumer law. The “accommodation contract” governs the stay and related services.

§ 3 Contract conclusion & deposit

The contract is deemed concluded once we accept your reservation (including electronic bookings). We may request a deposit of 10% of the total accommodation fee to secure the booking. Deposits are non-refundable if you cancel after the free-cancellation period.

§ 4 Start and end of accommodation

Unless otherwise agreed, the apartment is available from 4:00 p.m. on your arrival date. If you move in before 6:00 a.m., the preceding night counts as the first night. On departure day the apartment must be vacated by 10:00 a.m.; later check-out may incur an extra charge.

§ 5 Cancellation by the contract partner

You may cancel free of charge up to two days before arrival. Later cancellations and no-shows will be charged according to the confirmed rate. Please consult your booking confirmation for the exact cancellation policy.

§ 6 Cancellation by the accommodation provider

We may cancel the contract if the deposit is not received on time, if the guest shows gross improper behaviour or if an agreed special condition is not met. In such cases we will notify you immediately and refund any payments already made for unused nights.

§ 7 Provision of substitute accommodation

In justified cases (e.g. force majeure, operational needs) we may provide equivalent substitute accommodation nearby. The substitute must be of similar quality and free of extra cost to you; otherwise you may cancel without charge and receive a refund of any amounts already paid.

§ 8 Rights of the guest

By concluding the contract you gain the right to normal use of the booked apartment and all facilities customarily available to guests, subject to house rules. You may not sublet or exceed the agreed occupancy without our prior consent.

§ 9 Obligations of the guest

Please treat the apartment and furnishings with care and observe statutory quiet times. You are liable for damage you or your companions cause through fault. Smoking is prohibited inside the apartments and common areas; violations incur a cleaning fee of EUR 250 plus the cost of any additional cleaning required.

§ 10 Accommodation rates

Unless stated otherwise, published rates include VAT and operating costs. Additional services (e.g. extra cleaning, cot hire) are charged separately. The local visitor’s tax is payable as required by the municipality of Baden.

§ 11 Liability for belongings

Our liability for items brought by guests is governed by §§970 ff ABGB. Valuables should be stored in the safe provided; otherwise we can accept liability only within the limits set by Austrian law. We are not liable for damage caused by third parties or force majeure unless we are at fault.

§ 12 Liability limitations

We are liable only for intent and gross negligence. For consumers we are also liable for slight negligence in case of personal injury. Entrepreneurs bear the burden of proof for our fault; indirect damages, lost profit and consequential losses are excluded to the extent permitted by law.

§ 13 Smoking

Smoking is not permitted anywhere inside the apartments, staircases or terraces. Please use the designated outdoor smoking area with ashtray. If smoking occurs indoors we charge a cleaning fee and reserve the right to claim further damages.

§ 14 Pets

Pets are not allowed at Albizia Apartments unless expressly agreed in writing. Guests are liable for any damage caused by unauthorized pets.

§ 15 Extension of the stay

You have no automatic right to extend your stay, but we are happy to check availability. If departure is impossible due to unforeseeable events (e.g. heavy snow, flooding), the contract is extended for the duration of the obstruction under the conditions of §5 AGBH.

§ 16 Termination

The contract ends upon expiry of the agreed period. If you depart early, we may charge the agreed price minus any savings from re-letting. We may terminate without notice if you use the apartment in a grossly improper manner, endanger other guests or repeatedly breach house rules. In case of force majeure we may cancel the contract without liability.
